Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern the services provided by Callum Shaw/Callum Vision ("we," "our," or "us"). By booking with us, you ("the client") agree to these Terms. Our services include photography and videography content creation, brand advisory, and brand development.

2. Services Offered

  • Photography/Videography: Deliverables include specified photos/videos, edits, and usage rights as per the purchased package. Additional edits or services may incur extra charges.

  • Brand Advisory: Individual sessions offering tailored advice and strategies. Payment is required before each session.

  • Brand Development: Consultation and creation of websites, brand boards, and other visual assets. Deliverables will be agreed upon before starting the project.

3. Payments

  • All payments are in GBP unless otherwise stated.

  • Photography/Videography: 50% upfront payment is required to secure booking. Clients have 48 hours to cancel for a full refund of the deposit. The remaining balance is due after initial deliverables are presented (watermarked) and before final materials are released.

  • Brand Advisory: Full payment is required in advance of the scheduled session.

  • Brand Development: A 50% deposit is required to begin the project. Clients may cancel within 48 hours of payment for a full refund. The remaining balance is due after watermarked deliverables are presented, and final materials are released only after payment is complete.

4. Refunds and Cancellations

  • Refunds: Refunds for completed work are not available. For incomplete projects, partial refunds may be offered, minus any non-refundable deposits or work already completed.

  • Cancellations:

    • Photography/Videography: Full refund of deposit if canceled within 48 hours. Afterward, 50% of the deposit will be retained for work completed.

    • Brand Development: Same cancellation terms as above.

    • Advisory Sessions: 50% refund if canceled with at least 24 hours' notice. Failure to attend without notice results in forfeiture of the fee.

5. Revisions

  • Photography/Videography: Includes 2 rounds of edits. Additional revisions are charged at £50/hour (minimum 1 hour).

  • Brand Development: Includes 1 month of revisions. Additional revisions are charged at £50/hour (minimum 1 hour).

6. Ownership and Intellectual Property

  • Photography/Videography: Clients are granted usage rights for agreed purposes. We retain copyright ownership and the right to use the work in our portfolio unless otherwise requested.

  • Brand Development: Clients own final deliverables upon full payment. Drafts and concepts not selected remain our property.

7. Delivery Timelines

We provide estimated delivery timelines upon booking. Timely client cooperation (e.g., providing materials or feedback) is essential. Delays caused by the client may extend timelines.

8. Client Responsibilities

  • Photography/Videography:

    • Provide accurate information and arrive on time if attending shoots.

    • Ensure required permissions for shoot locations if responsible for arranging them.

  • Brand Development:

    • Provide necessary materials (e.g., text, images) on time.

    • Cover costs for website-building platforms and domains if applicable.

9. Liability

We are not responsible for delays, damages, or losses caused by:

  • Client delays or unresponsiveness.

  • Third-party actions or unforeseen events.

  • Misuse of deliverables by the client.

For on-site shoots, safety of the environment is our responsibility unless the client has arranged the location.

10. Confidentiality

We respect your confidentiality. Any shared personal or proprietary information will be kept private and used only for delivering services. We comply with data protection laws (e.g., GDPR).

11. Termination

We may terminate services if:

  • Payments are not made on time.

  • Unprofessional or inappropriate behavior occurs in which any refine is forfeiture

If we are unable to complete a project due to illness or injury, a full refund will be issued for undelivered work.

12. Dispute Resolution

Disputes will first be addressed through mediation. If unresolved, disputes will be governed by the laws of England and Wales.

13. Force Majeure

We are not liable for non-performance due to uncontrollable events (e.g., natural disasters, technical failures). In the case of illness or injury preventing us from completing the project, a full refund will be issued.

14. Amendments

We reserve the right to update these Terms. Significant changes will be communicated to clients.

15. Agreement

By booking our services, you confirm that you have read, understood, and agree to these Terms.
